CASL Enforcement Date Announced
This morning the federal government announced the coming into force date for Canada’s Anti-Spam Legislation (CASL) as July 1, 2014. While we have only just started our detailed analysis of the regulations we have identified several key items to be aware of at this time.
- Your existing ‘express’ consents will be grandfathered into the legislation after the coming into force date.
- Existing ‘implied’ consents will be valid during the three year transition period, starting July 1, 2014, and should be upgraded during this time.
- The Private Right of Action (PRA) section under CASL is delayed in enforcement until July 1, 2017.
- Additional exclusions for B2B emails have been included in the regulations so that organizations that already have an existing relationship and excluded from Section 6 of the Act.
Over the next couple of days we will post a more thorough explanation of the final regulations and how these will directly impact email marketing programs sent from and to Canada.
